General Terms and Conditions
1. Scope
The following General Terms and Conditions apply to all orders placed via our online shop by consumers and entrepreneurs.
The following applies to Germany: According to Section 13 of the German Civil Code (BGB), consumers are any natural person who concludes a legal transaction for purposes that can predominantly not be attributed to their commercial or independent professional activity.
The following applies to Austria: In the following conditions, "consumer" is understood to mean "consumer" within the meaning of the Consumer Protection Act (KSchG).
The following applies to Switzerland: In the following conditions, "consumer" is understood to mean "consumer" under Swiss law.
Entrepreneurs are all natural and legal persons who are not consumers.

2. Contractual partner, conclusion of contract, correction options

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you make a binding offer for the goods in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted.
We accept your offer within two days by
• submitting a declaration of acceptance in a separate email or
• having the goods delivered or
• if necessary, the payment transaction is carried out by our service provider or the selected payment service provider. The time at which the payment transaction is carried out depends on the payment method selected (see under "Payment").
The alternative that is relevant to you depends on which of the events listed occurs first.

We save the contract text and send you the order data and our general terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Delivery conditions
In addition to the stated product prices, shipping costs are added. You can find out more about the shipping costs in the offers.
We only deliver by post. Unfortunately, it is not possible to collect the goods yourself.
5. Payment
In our shop, the following payment methods are generally available:
Prepayment
If you select the payment method prepayment, we will give you our bank details in a separate email and deliver the goods after receipt of payment.
Credit card
When you place your order, you provide your credit card details. Your card will be charged immediately after you place your order.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify yourself with your access data and confirm the payment order. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the ordering process.
Sofort by Klarna
In order to be able to pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment order. Your account will be debited immediately after the order is placed. You will receive further information during the ordering process.
Apple Pay
In order to be able to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, identify yourself with your access data and confirm the payment order. The payment transaction is carried out immediately after the order is placed. You will receive further information during the ordering process.
Amazon Pay
In order to pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 Luxembourg (“Amazon”), you must be registered with Amazon, authenticate yourself with your access data and confirm the payment order. The payment transaction is carried out within one banking day after the order is placed. You will receive further information during the ordering process. Klarna In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will receive further information in the respective payment option and in the ordering process.
Purchase on account via Klarna
The invoice amount is due 14 days after the goods have been dispatched and the invoice has been received.
Would you like to shop today and only pay in 2 months? It's that easy: When completing your order, select the option “Pay in 2 months”. The purchase price is due no earlier than 2 months after the purchase. We will send you an invoice with the payment due date.
Fees incurred:
- €0.29 for an order value of €10.00 to €13.99
- €0.39 for an order value of €14.00 to €19.99
- €0.59 for an order value of €20.00 to €24.99
- €0.69 for an order value of €25.00 to €29.99
- €0.79 for an order value of €30.00 to €34.99
- €0.99 for an order value of €35.00 to €49.99
- €1.39 for an order value of €50.00 to €69.99
- €1.59 for an order value of €70.00 to €109.99
- €2.99 for an order value of €110.00 to €159.99
- €3.99 for an order value of €160.00 to €199.99
To take advantage of the offer, please order for at least €10.00 but no more than €199.99.
The total loan amount and the effective annual interest rate for repayment of the entire amount after 3 months are: for a purchase of €10: €10.29 or 11.76%, for a purchase of €14: €14.39 or 11.30%, for a purchase of €20: €20.59 or 11.96%, for a purchase of €25: €25.69 or 11.19%, for a purchase of €30: €30.79 or 10.68%, for a purchase of €35: €35.99 or 11.47%, for a purchase of €50: €51.39 or 11.27%, for a purchase of €70: €71.59 or 9.21%, for a purchase of €110: €112.99 or 11.96%. 11.02%, and for a purchase of €160 €163.99 or 10.11%. The effective annual interest rate can be both lower and higher and depends on the amount of credit granted by Klarna and the term.
Paying in 2 months is a promotional condition of Klarna's installment purchase. If you do not pay off your purchase in full by the specified date, the conditions for flexible installments automatically come into effect. You then pay off your purchase in convenient monthly installments.
If your purchase exceeds an amount of €199.99 for the first time, an effective agreement to "Buy now. Pay in 2 months" only exists when you have signed an installment purchase contract. The installment purchase contract will be sent to you by Klarna. You can sign the contract and thus convert your purchase into an installment purchase or pay the entire purchase price by the specified due date. The due date for this payment is 14 days from the dispatch of the goods, tickets, or in the case of other services, the time of availability of the services or digital content. If you are in arrears with payment, Klarna can demand a flat rate compensation of €1.20 for each reminder for the damage caused. You are entitled to prove that Klarna has suffered no or only less damage.
Instalment purchase via Klarna
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment is €6.95.

• Pay at least €6.95 /month or 1/24 of the total
• You do not need to provide a credit card number or bank details
• All your purchases are collected on one monthly invoice
• Shop now - pay at the end of next month
• Monthly installment purchase fee of €0.45, regardless of the number of purchases you make
• You can also pay the total amount at any time and end the installment purchase

For a purchase of €500 under the installment purchase basic conditions, the setup fee is €0. The applicable interest rate is 11.95%, which corresponds to an effective annual interest rate of 14.79% with a monthly installment purchase fee of €0.45. The total amount is €538.35. With 12 installment payments, each installment is €44.86. This example assumes that the payment is made within one year. The effective annual interest rate can be either lower or higher and depends on the amount of credit granted to you by Klarna. The monthly payment is due upon receipt of the monthly invoice.

6. Right of withdrawal

Consumers have a right of withdrawal as described in the cancellation policy. Businesses are not granted a voluntary right of withdrawal.

7. Retention of title

The Goods remain our property until full payment has been made. For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.
The following also applies to entrepreneurs: We retain title to the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale - regardless of whether the reserved goods are combined or mixed with a new item - in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations. We will release the securities to which we are entitled at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
8. Transport damage
The following applies to consumers: If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and please contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you do help us to assert our own claims against the freight carrier or transport insurance.
The following applies to entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the freight forwarder, the freight carrier or the person or institution otherwise designated to carry out the shipment.
9. Warranty and guarantees
9.1 Liability for defects
The following applies to consumers based in Germany and Austria:

You should check the condition of the item received as soon as possible in the normal course of business and, if defects arise for which the seller is liable, notify the seller immediately. If the consumer fails to do so, the purchased item is deemed to have been approved, unless the defects were not apparent during the usual inspection. If such defects arise later, the notification must be made immediately after discovery, otherwise the item will be deemed to have been approved with regard to these defects.
Send the defective product back to us with a description of the defect. You will bear the transport costs incurred. We provide a guarantee by remedying defects. This is done at our discretion either by eliminating the defect (repair) or by delivering a defect-free item (replacement delivery). If the subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a price reduction is excluded.
The following applies to entrepreneurs and merchants:
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following restrictions and shortening of deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, body or health
• in the event of intentional or grossly negligent breach of duty and fraud
• in the event of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations)
• within the framework of a guarantee promise, if agreed, or
• insofar as the scope of application of the Product Liability Act is open.
Restrictions on entrepreneurs
For entrepreneurs, only our own information and the manufacturer's product descriptions that were included in the contract are considered to be an agreement on the quality of the goods; we accept no liability for public statements by the manufacturer or other advertising statements. For entrepreneurs, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk. The sale of used goods is subject to the exclusion of any warranty. The statutory limitation periods for the right of recourse under Section 445a of the German Civil Code remain unaffected.

Regulations for merchants

The obligation to inspect and give notice of defects set out in Section 377 of the German Commercial Code applies to merchants. If you fail to give notice as set out there, the goods are deemed to have been approved, unless the defect was not apparent during the inspection. This does not apply if we have fraudulently concealed a defect.

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, body or health,
• in the event of intentional or grossly negligent breach of duty,
• in the event of a guarantee promise, if agreed, or
• insofar as the scope of application of the Product Liability Act is open.
In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the amount of liability is limited to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

12. Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are prepared to participate in an out-of-court arbitration procedure before a consumer arbitration board.

13. Final provisions
If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
